Spells don't have to just "work" or "not work". There are shades of function in the middle. And this just gets us back to what Darkmoon and Raye were talking about at the tavern. If the spell fails there has to be a contingency. Well, the spell may not have failed but it may not have worked either so good thing there's already talk of a contingency.
